Officer Stewart was assigned to a plain clothes unit at the Detroit Police Department's 9th Precinct.
On August 11, 2002 he and his partners were patroling the area of Corbett and Connors on the city's east side around 2:30am. This area is a high narcotic area and weapon possession area.
As Officer Stewart and his partners were driving up Corbett, they noticed a group of men gambling in the street. As they approached in an unmarked vehicle, the men looked up. One man grabbed his waistband and tried to head back towards his home. Officer Stewart and his partners exited their vehicle and apprehended the suspect just before he reached his front porch. The suspect was armed with an illegal handgun.
As Officer Stewart and his partners were handcuffing the suspect, the other gamblers took off running. Officer Stewart's partners, he had 2 that night, pursued them.
There was a large birthday party of about 40-50 people for the arrested suspect that night. The party became irate and started screaming at officer Stewart and his partners. When Officer Stewart's partners left the area in pursuit of other suspects, Officer Stewart started to walk the suspect back to his scout car.
At this time, the suspect's brother-in-law came running from across the street, approached Officer Stewart from behind and shot ,striking him in the back of the head.
Officer Stewart was transported to Detroit Receiving Hospital, where he legally died later that morning. Officer Stewart had actually died instantly at Corbett, but his body was kept alive for organ donation.

Officer Stewart and his partner were called to the 11200 block of Corbette in the report there was a group of men gambling on the sidewalk. When they arrived, Officer Stewart discovered one man was carrying a concealed handgun. As Officer Stewart was cuffing the suspect, another man approached Officer Stewart from behind and fired one shot at his head. Officer Stewart was rushed to St. John Hospital where he died several hours later from his wound.
The suspect fled the scene but turned himself in the following day. The man was convicted of first degree murder and sentenced to life in prison with no possibility of parole.
